These terms apply to all contracts for the acquisition of licences and for the booking of premium services (§ 7) for the software Ovemio that are concluded via ovemio.com or via the software itself. Deviating terms of the customer do not become part of the contract unless we expressly agree to them in text form.
A consumer is any natural person who concludes the contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB). An entrepreneur is anyone who acts in the exercise of a commercial or independent professional activity (§ 14 BGB). For the volume customer area, the Partner Terms apply in addition.
§ 2 Subject matter of the contract
Ovemio is a player without any content of its own. The software contains no TV channels, no films, no radio stations and no playlists. It does not provide access to content and does not broker any such access.
The subject matter of the contract is exclusively the right to use the software. The customer decides for themselves which sources they enter into the software; they alone are responsible for the lawfulness of those sources (see § 8).
What is acquired is the base version of major version 1 of the software — all releases whose version number begins with "1.". Separately offered additional services (premium services) are not part of the licence purchase. What this means for updates, for premium services and for a possible later major version is set out in § 7.
§ 3 Conclusion of the contract
The presentation of the licences on our pages does not constitute a binding offer, but an invitation to place an order.
- The customer selects a package, provides their e-mail address and confirms the required declarations.
- By clicking "Order with an obligation to pay", the customer submits a binding offer.
- The contract is concluded as soon as we accept the order — by providing the licence key or by a confirmation in text form.
The text of the contract is not stored separately. These Terms and Conditions and the withdrawal policy can be accessed and saved on this page at any time; the customer receives the order data by e-mail.
The language of the contract is German.
§ 4 Prices and payment
All prices are final prices in euros and include statutory value added tax. No shipping costs are incurred, as delivery is made electronically.
Payment is processed via the payment service provider Stripe Payments Europe, Ltd. We do not receive or store any card data. The terms of the payment service provider apply in addition.
The purchase price is due immediately upon conclusion of the contract.
Purchase within the app via an app store. If the licence is purchased within a release of the software obtained via an app store, the price may differ from the price on our website. The reason is the fees of the respective store operator. The price applicable in each case is displayed before the order is placed.
§ 5 Provision
After receipt of payment, we generate the licence key and send it without undue delay to the e-mail address provided by the customer. In addition, it is displayed for a short time on the confirmation page.
The licence key must be kept safe. It is the proof of the acquired licence. The customer must ensure that the e-mail address provided is correct and reachable. If the key is lost, we will help within reasonable limits; there is no entitlement to replacement of a lost licence unless we are at fault.
§ 6 Right of use
Upon full payment, the customer receives a simple, temporally unlimited, non-exclusive right to use the software to the agreed extent.
- One licence entitles the customer to simultaneous use on up to three devices. The type of device can be freely chosen. Additional device slots can be purchased individually at the price stated in each case.
- The licence is bound to the customer. Passing it on to third parties, renting it out and use by several households are not permitted.
- The customer may not reverse engineer or modify the software or circumvent protection mechanisms, unless this is permitted by law.
- Resale or commercial distribution of the software or of licence keys is only permitted within the framework of a separate volume customer agreement.
Exception for open-source components (LGPL). The above prohibition of reverse engineering, decompilation and modification expressly does not apply to those parts of the software that are licensed under the GNU Lesser General Public License (LGPL) (in particular the included libraries FFmpeg and libmpv), nor within the scope of the mandatory statutory exceptions (in particular § 69e UrhG for establishing interoperability). To the extent required under the LGPL v2.1, the customer is permitted to modify and reverse engineer the said LGPL libraries for their own use, in order to examine the software for their own use (debugging) and to enable the correction of errors in such modifications, and to replace the libraries with other versions. The corresponding source code and provision information are available at https://ovemio.com/quellen/.
§ 7 Updates
The software is a digital product within the meaning of §§ 327 et seq. BGB. During the provision period, we provide updates that are necessary for the software to remain in conformity with the contract — including security updates — and inform the customer about them.
Since the licence is acquired for an unlimited period, the period is determined by what the customer can expect given the type and purpose of the software; it amounts to at least two years from provision.
If the customer does not install an update provided within a reasonable period, we are not liable for defects resulting solely from this — provided that we have informed the customer about the update and the consequences of failing to install it.
Scope of the licence: major version 1
The licence applies to the base version of major version 1 of the software — all releases whose version number begins with "1." (currently 1.19.x), with all functions except the premium services under the following paragraph. Within this major version, all updates to the base version are included in the purchase price, without time limit and without further payment: bug fixes, security updates and new functions alike. This is what is meant by the statement "all updates of version 1 are included" on our pages.
Premium services are not included. Premium services are functions that we offer separately for a fee and identify as an additional service subject to a charge. They are not part of the base version and are excluded from the commitment in the preceding paragraph. Premium services are agreed and paid for separately; we state the price, term and cancellation before booking. There is currently one premium service: the "Main URL + additional URLs" function, i.e. the second to tenth server address of an access; the main URL itself is part of the base version. Until 30 September 2027, the function is available to every licence as an open beta free of charge, thereafter only with a booking. Without a booking, the access continues to run via the main URL; the base version remains fully usable.
A future major version 2 — releases whose version number begins with "2." — is a separate product and is not covered by this licence; it would have to be acquired separately. Whether, when and at what price such a release will appear is open; there is no entitlement to it.
If a major version 2 is released, major version 1 remains usable without restriction and continues to receive the updates under the first three paragraphs of this § 7, i.e. those necessary to maintain conformity with the contract, including security updates. We only introduce a new major version if the structure or technical foundations of the software change to such an extent that the previous release cannot be continued. It is not a means of ending the maintenance of major version 1 prematurely.
The statutory update obligations for digital products (§§ 327f, 327s BGB) remain unaffected. They apply to the major version acquired by the customer and are not restricted by this provision.
§ 8 Content and responsibility of the customer
The software contains no content and no sources. The customer enters all playlists, server addresses and access data themselves.
The customer is solely responsible for ensuring that the sources they use are lawful and that they are entitled to use them. We do not check any sources, do not store any content and do not broker any access.
We assume no responsibility for third-party content, its availability or lawfulness. There is no entitlement to a particular source working or remaining available, and this is not the subject matter of the contract.
TMDB extension. The app only displays film and series data from the database TMDB (The Movie Database), such as cast, age ratings and trailers, if the customer enters their own TMDB key. The key is an access of the customer at TMDB. It is governed solely by the terms of use that the customer agrees with TMDB; according to these, the free key is intended only for non-commercial purposes. We are not a party to this access and do not owe that TMDB supplies data. The child profile function relies on the age ratings of TMDB; without a key, a child profile shows no films or series. We do not warrant the accuracy, completeness and age-appropriateness of the data from TMDB; liability under § 11 remains unaffected. The duty to supervise the media use of minors remains with the customer. Ovemio uses the TMDB API but is neither endorsed nor certified by TMDB.
We are entitled to block a licence if the customer materially breaches these terms, in particular in the event of passing it on to third parties or abusive duplication. Before blocking, a request to remedy the breach is made, where possible and reasonable.
§ 9 Right of withdrawal
Consumers have a right of withdrawal. Details and the model withdrawal form can be found in our withdrawal policy.
The right of withdrawal expires prematurely if we have begun providing the service after the customer has expressly consented to this and confirmed that they thereby lose their right of withdrawal (§ 356 para. 5 BGB). The customer makes both declarations in the ordering process.
§ 10 Defects
The statutory provisions on rights in the event of defects in digital products apply. The customer is asked to report defects to info@ovemio.com; the report is not a prerequisite for their rights.
§ 11 Liability
We are liable without limitation in cases of intent and gross negligence, in cases of injury to life, body or health, where a guarantee has been assumed, and under the German Product Liability Act (Produkthaftungsgesetz).
In the event of a slightly negligent breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may rely (cardinal obligation), liability is limited to the damage typical for the contract and foreseeable at the time the contract was concluded. In all other respects, liability is excluded.
We are not liable for damage arising from the customer's use of unlawful sources.
§ 12 Data protection
How we handle personal data is set out in our privacy policy.
§ 13 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§ 14 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which the consumer has their habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is Hungen.
Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
